TERMS OF SERVICE

By receiving art from me in any way, or purchasing an adopt / design, you agree to these terms whether or not you have actually read them.I may ask for confirmation that you have read & agree to my terms of service before accepting a sale or commission.Not agreeing with my terms of service does not make you an exception to them. If these terms do not work for you, please don't work with me.

GENERAL

♡ I will not accept monetary payment from those who are under 18. I may work with those who are under 18 when it comes to trades and freebies at my own discretion.
♡ I retain the right to refuse service for any reason.
♡ I retain the right to reuse scrapped sketches and rejected custom design elements & ideas.
♡ My turn-around time (tat) will be listed when I open commission slots, it can also be found in my trello. Due to my real life responsibilites and health, it may be subject to change. I will keep you updated of any major delays.
♡ Harassment towards myself, my commissioners, or owners of my designs will result in being blacklisted.

PAYMENT & REFUNDS

♡ I accept payment via ko-fi or stripe, unless otherwise stated. I cannot work with cashapp. I will only work with paypal as a last resort.
♡ All prices are in united states dollars (usd) unless otherwise stated.
♡ Full payment is required up front unless a payment plan or hold has been discussed prior.
♡ Payment should be sent within 48 hours of me telling you where to pay / sending the invoice.
♡ You have up until I send you the sketch for approval to request a full 100% refund on a commission. Depending on amount of work done, after this point I may refuse a refund, or only refund a portion of the funds.
♡ If I am unable to complete your commission due to a problem on my end, you will be refunded in full.
♡ Do not bid or commit to buying if you cannot pay. Repeatedly retracting bids & ghosting will result in being blacklisted.
♡ Forcing a refund / chargeback will result in being blacklisted. I am not responsible for buyer's remorse.

ORDERING & COMMISSION PROCESS

♡ You must have a clear character reference sheet. I may work with traditionally drawn refs, as long as it has clear markings and a digital color palette. I do not work with descriptions (this does not apply to custom designs).
♡ I will work with any body type / gender, and with most species. For a list of what I will and won't draw, see this page.
♡ Please be clear about what you want when ordering a commission from me.
♡ Quotes are free. Feel free to reach out and discuss your ideas.
♡ I will not start working until I have received payment in full.
♡ I will not accept commissions that ask me to recreate someone else's artwork or character(s).
♡ Please make sure you keep a line of communication open. Failure to respond may result in your commission being delayed or put on hold.
♡ Once the sketch has been approved by you, i will start lining. you may not ask for major lineart changes after this point. Please communicate with me if there's anything you are not fully happy with as soon as possible.
♡ You will receive progress shots of the sketch, the lines, the colors, and the final piece. You are welcome to request any minor edits or updates / progress shots in-between.
♡ I may or may not keep the psd files of commissioned artwork, please let me know of any mistakes or edits as soon as possible as i may not be able to correct them later on.

ADOPTS & DESIGNS

♡ You are free to make whatever edits you'd like (gender, markings, species, whatever) as long as the design is still recognizable. You may edit the design file, as long as the original remains in their gallery & I am still credited as the original designer.
♡ You may not claim my designs as your own, even if you have made changes.
♡ You may not edit the designs to look like other designs I've made, my own characters, or characters owned by others. This will be dealt with on a case-by-case basis.
♡ You may not edit any additional artwork that comes with the character, whether by me or others, without explicit permission from the artists.
♡ It may take anywhere from a few hours & up to a week for me to close an auction / offer-to-adopt and accept an offer, if they are not auto-bought. This gives me time to gauge interest, and gives others the opportunity to bid.
♡ You may gift, trade, and sell my designs freely. You may not resell the design for more than they were purchased without adding additional artwork.
♡ Do not artificially inflate the worth of my designs, whether through "ghost sales" or marking up artwork value. Sentimental value & connection unfortunately does not add monetary value to a design.
♡ Do not place your own restrictions on my designs (such as "they must only be traded/sold back to me" or telling someone what they can and can't do with the character).
♡ You may not create split / "sibling" designs or use my designs as "breedables". All versions of the designs must stay one character.
♡ All of my designs must stay on toyhouse. Do not delete them off the site. I'm happy to provide invite codes. If they're private i'd love to be authorized or given a key !!
♡ You may use my designs for nsfw or fetish content, provided you are of legal age & the characters are depicted as adults.
♡ Do not provide any of my adoptables or designs to anyone on my blacklist, whether it be through gift, trade or sale. No exceptions.

♡ I retain all intellectual rights & copyright over the work I create. My work is protected under copyright law. It is not for free, public use.
♡ I reserve the right to use commissioned work as examples. I may post finished commission work on my social media accounts. I will never use commissioned work for merchandise to sell (prints, stickers, etc).
♡ Only the intended recipient of the artwork may use it, and only for personal (non-commercial) use - such as personal prints, personal t-shirt, profile picture, etc. Personal use only counts if its for Your use only.
♡ You may not use my artwork commercially / to make profit. This includes but is not limited to prints, stickers, t-shirts, etc.
♡ Do not remove or obscure my signature. This does not include cropping for profile pictures or banners.
♡ You may not use my work in any way, shape or form to promote or depict bigotry (homophobia, transphobia, anti-choice/pro-life, nazism/white supremacy etc) or things like zoophilia, pedophilia, etc.
♡ You may not use my designs or artwork in anything ai or nft/crypto related.
♡ You may repost your commission as long as I am credited.
♡ You may not trace or heavily reference my work, even with credit. This includes bases.
♡ You may not repost or use my personal artwork.
